These cases will be restricted from entry into Vietnam

Entry means a movement of people across a border into a territory of a country. Persons wishing to enter the country must have entry visas unless exempted. In some cases, foreigners will be restricted from entry into Vietnam in accordance with the Law on Entry, exit, transit, and residence of foreigners in Vietnam in 2019.

  1. Principles of entry and exit

According to Article 4 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2019, the principles of entry, exit, transit, and residence include:

a) Comply with the provisions of this Law, other relevant laws of Vietnam or international treaties to which Vietnam is a member.

b) Respect independence, sovereignty, unity, and territorial integrity ensure national security and social order and safety and equality in international relations.

c) Ensuring publicity, transparency, and convenience for foreigners; closely and uniformly managing the entry, exit, transit and residence activities of foreigners in Vietnam.

d) Foreigners with multiple passports may use only one passport for entry, exit, transit or residence in Vietnam.

  1. Conditions for entry

Foreigners may enter Vietnam when they fully meet the conditions specified in Article 20 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam in 2019 as follows:

Passport or international valid papers and visas.

Foreigners on entry unilaterally exempt from visas must have a valid passport of at least 06 months and at least 30 days from the time of their previous exit from Vietnam.

Not in the case of not being allowed for entry as prescribed in Article 21 of the Law on Entry, exit, transit, and residence of foreigners in Vietnam 2019.

However, if those who meet the conditions for entry but fall into the cases specified in it will not be allowed to enter, specifically:

  • Children under 14 years of age without a parent, guardian or authorized person accompany.
  • Forging papers, making false declarations in order to be granted valuable papers on entry, exit, and residence.
  • People suffering from mental illness or infectious disease endangering public health.
  • Being expelled from Vietnam for less than 03 years from the effective date of the expulsion decision
  • Being forced to leave Vietnam for less than 06 months from the date the decision on forced departure takes effect.
  • For disease prevention and control reasons.
  • For disaster reasons.
  • For national defense, security, social order, and safety reasons.
  1. Competence to decide not to allow entry

According to Article 22 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2019, the authority to decide whether to enter the country belongs to:

a) The head of the immigration control unit decides

b) The Minister of Health has decided not to allow entry

c) Minister of Agriculture and Rural Development

d) The Minister of Public Security and the Minister of Defense

Persons competent to issue decisions not permitting entry are competent to clear the decisions not yet allowed for entry and take responsibility before law for their decisions.
